Waterguard Product Warranty
1. Scope of the warranty
These warranty terms apply between Waterguard Intl. AS, organization number 984 750 862, Bragernes Torg 2A, 3017 DRAMMEN (hereinafter "Waterguard") on the one hand, and the consumer or a business customer (approved installer) on the other hand.
The warranty applies to Waterguard products and accessories as covered on www.waterguard.no.
The warranty aims to provide consumers and business customers with extended protection compared to general consumer law provisions.
The warranty does not replace standard insurance schemes, such as water damage insurance, contents insurance, etc.
2. Conditions for the warranty's validity
For the warranty to be valid, the consumer must document or otherwise demonstrate that the following conditions are met:
- The product must have been purchased from one of Waterguard's authorized dealers within five years before a warranty claim arises.
- The product must have been installed and tested by an authorized plumber before being put into use.
- If the product has been connected to a home alarm system or similar electronic systems, this must have been done by an authorized electrical installer.
- The product must have been installed and tested by the installer in accordance with Waterguard's installation guide.
- During the warranty period, the product must have been used, tested, and maintained by the consumer in accordance with Waterguard's user guides.
- The product must have been assembled only with Waterguard original parts.
3. Scope of the warranty
Waterguard guarantees that the product will function for its intended purpose and without functional defects or other types of material or software deficiencies from the time of purchase and for five years thereafter.
During the warranty period, Waterguard covers the costs of repairing the relevant product or a replacement product if the relevant product cannot be cost-effectively repaired.
Installation of the replacement product, carried out by an authorized installer, is covered if required by applicable law.
Waterguard products are further covered by general liability and warranty insurance, limited to NOK 200,000 per incident for personal and/or property damage.
When selling from Waterguard to professional business customers (approved installer), Waterguard is responsible for defects according to NS8409:2008 section 11.
4. Limitations on warranty liability
Waterguard is not liable for functional defects or other deficiencies in the product that arise from other than the product’s design and execution, including customer's own alarm system failure, mechanically inflicted damage, etc.
Waterguard is not responsible for the replacement and/or repair of the product, nor for any other direct economic loss resulting from a breach of warranty.
Waterguard's responsibility does not include consequential loss, incidental loss, or other forms of indirect losses.
The consumer is also responsible for trying to limit a potential or actual scope of damage as far as possible. If the consumer fails to limit such damage, Waterguard’s liability for compensation may be mitigated or voided entirely.
5. Warranty claims and complaints
Waterguard must be notified as soon as possible if a defect in the product may lead to a warranty and/or compensation claim, such as in the case of the risk of water damage.
Waterguard has the right to choose whether Waterguard’s own personnel or other authorized professionals should be sent to the installation site and to decide how the warranty claim can be met.
If Waterguard does not respond within a reasonable time to the consumer's inquiry, the consumer has the right to contact an authorized plumber directly.
In sales from Waterguard to professional business customers (approved installer), the rules for complaints about received deliveries to B2B customers follow the rules according to N8409:2008 sections 12.1, 12.2, and 12.3. The complaint must be lodged within 5 years from the received delivery.
6. The consumer's liability for damages
The consumer may be held liable for expenses, costs, and other losses incurred by Waterguard in following up on the consumer's unjustified warranty claims, including but not limited to its own resource use, expenses, and costs for authorized plumbers or other qualified professionals, travel expenses, etc.
7. Jurisdiction
In disputes or other disagreements regarding the validity, interpretation, or enforcement of this product warranty, Norwegian law shall apply. Disputes that cannot be resolved through amicable negotiations between the consumer and Waterguard shall be resolved by the ordinary Norwegian courts unless mandatory legislation stipulates that another jurisdiction shall apply.
8. Extended Warranty for Activated Waterguard+ Systems
Waterguard+ systems that are activated by an authorized installer (according to installation instructions) automatically receive an extended warranty of a total of 10 years. An activated system means that the system is registered in the Abra cloud connection via an internet connection.
9. Change of Warranty Terms
Waterguard reserves the right to update and adjust the warranty terms.
